RETURNS AND REFUNDS POLICY

IMPORTANT NOTICE
This Returns and Refunds Policy ("Policy") explains the circumstances in which customers may request cancellations, returns, refunds, repairs, replacements, price reductions or other remedies in relation to products purchased through the Thirandal Midukku Ltd Platform ("Platform").
Please read this Policy carefully before placing an order.
This Policy should be read together with the:
- Terms and Conditions;
- Customer Agreement;
- Vendor Customer Terms; and
- Website Terms of Use.
Nothing in this Policy limits, excludes or removes any statutory rights available to customers under applicable law.
1. ABOUT THIS POLICY
Thirandal Midukku Ltd operates an online marketplace connecting customers with independent vendors.
Products purchased through the Platform are generally sold by independent vendors. Unless otherwise stated, the contract for the sale of a product is between the customer and the relevant vendor.
Vendors are responsible for complying with applicable laws relating to the products they sell, including applicable consumer protection requirements.
Thirandal Midukku Ltd provides the Platform and may assist with customer communications, complaints and dispute resolution. However, Thirandal Midukku Ltd is not generally the seller of products listed by independent vendors.
This Policy applies to purchases made through the Platform and should be read together with the other applicable Platform terms and policies.
2. CUSTOMER RIGHTS
Customers may have legal rights and remedies under applicable consumer protection legislation, including, where applicable:
- the Consumer Rights Act 2015;
- the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; and
- other applicable consumer protection legislation.
Depending on the circumstances, a customer may have the right to:
- cancel an eligible order;
- return a product;
- receive a refund;
- request a repair;
- request a replacement;
- receive a price reduction; or
- exercise another remedy available under applicable law.
The availability of a particular remedy will depend on the circumstances of the transaction and the rights provided by applicable law.
3. CHANGE-OF-MIND CANCELLATIONS
Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, customers generally have a statutory right to cancel eligible distance contracts within 14 days after receiving the goods, without giving a reason.
The cancellation period may apply differently where an order contains multiple goods delivered separately.
To exercise a statutory cancellation right, customers should clearly notify the relevant seller or Thirandal Midukku Ltd of their decision to cancel.

Customers may also contact the relevant vendor where the vendor has provided a specific returns or cancellation process.
After notifying the seller of cancellation, customers generally have a further 14 days to return the goods, unless the seller has agreed to collect them.
Customers should take reasonable care of goods before returning them.
Customers are entitled to handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in a manner similar to what would ordinarily be permitted in a physical retail store.
Where a customer handles goods beyond what is reasonably necessary, the customer may be responsible for any resulting reduction in value, where permitted by law.
4. PRODUCTS EXCLUDED FROM CHANGE-OF-MIND CANCELLATION RIGHTS
Certain products may be excluded from statutory cancellation rights where an applicable legal exception applies.
Depending on the circumstances, these may include:
- personalised products;
- bespoke or custom-made products;
- products made to the customer's specifications;
- goods that are liable to deteriorate or expire rapidly;
- sealed products that cannot be returned for health or hygiene reasons once the seal has been broken; and
- other products or circumstances for which a statutory cancellation exception applies.
Where possible, any applicable cancellation exclusion will be clearly identified in the relevant product listing before purchase.
Important: An exclusion from change-of-mind cancellation rights does not remove a customer's statutory rights where the product is faulty, defective, not as described or otherwise fails to comply with applicable legal requirements.
5. FAULTY, DAMAGED OR DEFECTIVE PRODUCTS
Customers should inspect products within a reasonable time after delivery.
If a product is:
- faulty;
- damaged;
- defective;
- incomplete;
- unsafe;
- not as described; or
- otherwise does not meet applicable legal requirements,
the customer should contact the relevant vendor or Thirandal Midukku Ltd as soon as reasonably practicable.
Depending on the circumstances and applicable law, customers may be entitled to:
- reject the goods and receive a refund;
- request a repair;
- request a replacement;
- receive a price reduction; or
- exercise another statutory remedy.
Nothing in this Policy limits any statutory rights relating to faulty or defective goods.
Where required by applicable law, a vendor may be responsible for providing the appropriate remedy.
6. INCORRECT OR MISSING ITEMS
If a customer receives an item that is different from the item ordered, or an item is missing from an order, the customer should notify the relevant vendor or Thirandal Midukku Ltd as soon as reasonably practicable.
Customers may be asked to provide:
- their order number;
- photographs of the item received;
- photographs of the packaging, where relevant;
- delivery information;
- a description of the issue; and
- any other reasonable information required to investigate the matter.
The relevant vendor will normally be given an opportunity to investigate the issue and provide an appropriate resolution.
7. RETURN REQUEST PROCESS
To request a return, refund, repair or replacement, customers should provide, where applicable:
- order number;
- customer name;
- contact details;
- product details;
- description of the issue;
- reason for the return;
- photographs or other supporting evidence where appropriate; and
- proof of purchase where reasonably required.
Customers should retain proof of postage or other evidence of return until the return has been confirmed as received or the matter has otherwise been resolved.

8. RETURN AUTHORISATION AND INSTRUCTIONS
Where a return is required, customers should follow the return instructions provided by the relevant vendor or Thirandal Midukku Ltd.
Customers should not send products to an address that has not been provided or authorised for returns.
Unauthorised returns may cause delays in processing.
However, nothing in this section is intended to prevent a customer from exercising a statutory right to cancel or return goods.
Where return instructions are required, we or the relevant vendor will provide reasonable instructions for returning the product.
9. RETURN SHIPPING COSTS
Responsibility for return shipping costs depends on the reason for the return and the applicable legal requirements.
9.1 Faulty, damaged or incorrect products
Where a product is returned because:
- it is faulty;
- it is defective;
- it was damaged before or during delivery;
- it is not as described; or
- the wrong product was supplied,
the relevant vendor will generally be responsible for reasonable return costs where required by applicable law.
9.2 Change-of-mind returns
Where a customer exercises a statutory change-of-mind cancellation right, the customer may generally be responsible for the direct cost of returning the goods, unless:
- the vendor has agreed to pay the return cost;
- the vendor failed to provide the required information about return costs; or
- applicable law requires the vendor to bear the cost.
Where the law requires the vendor to reimburse delivery charges following a valid cancellation, the applicable statutory rules will apply.
10. REFUND PROCESS
Where a refund is approved or legally required, it will generally be made using the original payment method used for the purchase, unless otherwise agreed or permitted by law.
For statutory cancellations, refunds will be processed within the time required by applicable law.
Where applicable to a distance-sale cancellation, the refund will generally include the cost of standard delivery paid by the customer. If the customer selected a more expensive delivery option, the additional cost of that upgraded delivery option may not be refundable where permitted by law.
For returned goods, the refund may be processed after the goods have been received or after the customer provides appropriate evidence that the goods have been returned, in accordance with applicable law.
Refunds may take additional time to appear in the customer's account due to:
- payment provider processing times;
- banking processes;
- international payment processing; or
- currency conversion.
We will not knowingly delay a refund beyond the period permitted by applicable law.
11. PARTIAL REFUNDS AND PRICE REDUCTIONS
Depending on the circumstances and applicable law, a partial refund or price reduction may be appropriate, including where:
- only part of an order is affected;
- a statutory price reduction applies;
- the customer agrees to retain a product at a reduced price; or
- another partial remedy is agreed between the customer and the relevant vendor.
A partial refund or price reduction will not be used to remove a statutory right where the law requires a different remedy.
12. CIRCUMSTANCES AFFECTING REFUNDS
A refund or remedy may be affected where the customer:
- intentionally damages the product;
- alters or modifies the product after delivery;
- uses the product beyond what is reasonably necessary to inspect or assess it, where applicable law permits an adjustment for resulting loss in value;
- provides materially false or misleading information; or
- makes a fraudulent claim.
However, this section does not affect statutory rights that cannot lawfully be excluded or restricted.
Customers should retain proof of postage or other evidence showing that a return was sent.
If a customer claims to have returned a product but the vendor does not receive it, the parties may be asked to provide available evidence, including:
- proof of postage;
- tracking information;
- delivery confirmation;
- photographs;
- correspondence with the carrier; or
- other relevant evidence.
The matter will then be investigated and resolved in accordance with applicable law.
13. PARCELS LOST BEFORE DELIVERY
If a parcel appears to have been lost before delivery, the customer should notify the relevant vendor or Thirandal Midukku Ltd as soon as reasonably practicable.
An investigation may involve:
- courier tracking information;
- postal tracking information;
- delivery confirmation checks;
- communication with the relevant carrier;
- confirmation of the delivery address; and
- other relevant information.
Depending on the circumstances, the resolution may include:
- replacement of the product;
- a refund;
- re-delivery; or
- another appropriate arrangement.
Nothing in this section limits statutory rights relating to delivery or non-delivery.
14. DELIVERY DELAYS
Estimated delivery dates and times may vary depending on the destination, vendor, carrier and other circumstances.
Delivery may be delayed by factors including:
- customs authorities;
- postal services;
- courier services;
- weather conditions;
- government restrictions;
- transportation disruptions;
- strikes or labour disputes; or
- other events beyond reasonable control.
- A delivery delay does not automatically remove the customer's statutory rights.
Where a legally agreed or required delivery period has not been met, customers may have rights to require delivery within an additional appropriate period and, in certain circumstances, to cancel the contract and obtain a refund.
Each case will be assessed in accordance with the applicable contract terms and law.
15. INTERNATIONAL ORDERS
For international orders, customers may be responsible for charges imposed by the destination country, including:
- customs duties;
- import taxes;
- local taxes;
- currency conversion charges;
- payment provider fees; and
- local administrative or handling charges.
Such charges are generally separate from the product price and may be non-refundable unless applicable law provides otherwise.
Customers are responsible for checking relevant import restrictions, customs requirements and applicable charges before placing an international order.
Where a customer refuses or fails to accept delivery because of customs charges or import requirements, any resulting refund or return will be handled in accordance with applicable law and the circumstances of the transaction.
16. DISPUTES AND COMPLAINTS
Customers should normally first attempt to resolve product-related issues directly with the relevant vendor.
Where appropriate, Thirandal Midukku Ltd may assist by:
- facilitating communication;
- requesting information from the relevant parties;
- helping clarify the relevant Platform procedures; or
- assisting with the practical resolution of a dispute.
The extent of our involvement will depend on the circumstances.
Where Thirandal Midukku Ltd is acting only as a marketplace operator and is not the seller of the relevant product, the underlying contractual dispute will generally be between the customer and the relevant vendor.
Nothing in this section affects any statutory rights or remedies available to customers.
17. FRAUD PREVENTION
To protect customers, vendors and the Platform, we or the relevant vendor may request reasonable additional information or evidence before processing certain refunds or returns.
This may include:
- proof of purchase;
- photographs;
- tracking information;
- proof of return;
- delivery information; or
- other information reasonably required to investigate a claim.
Where there are reasonable grounds to suspect fraud or abuse, we may delay processing while the matter is investigated.
Fraudulent claims may result in:
- refusal of an illegitimate claim;
- account suspension or restriction; or
- referral to relevant authorities or legal action where appropriate.
This does not affect any genuine statutory consumer claim.
18. CHANGES TO THIS POLICY
We may update this Policy from time to time to reflect changes in:
- our services;
- our business practices;
- Platform procedures;
- applicable law;
- regulatory requirements; or
- other operational circumstances.
Updated versions will be published on the Platform together with the revised "Last Updated" date.
Changes will generally apply to future purchases and future use of the Platform.
Where required by law, existing orders or claims will continue to be governed by the terms applicable at the relevant time.
19. GOVERNING LAW
This Policy shall be governed by and construed in accordance with the laws of England and Wales, except where applicable mandatory consumer protection law provides otherwise.
20. STATUTORY RIGHTS
Nothing in this Policy limits, excludes or affects any statutory rights or remedies that customers may have under applicable consumer protection legislation.
In particular, this Policy is not intended to exclude or restrict rights that cannot lawfully be excluded or restricted.
Where a provision of this Policy conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail.
Thirandal Midukku Ltd is not obliged to participate in an alternative dispute resolution procedure unless required by applicable law or expressly agreed to do so.
